Approval of Climate Projects – Designated National Authority / Designated Focal Point (DNA/DFP)

If you are to obtain an approval for a climate project, you may contact the Danish DNA/DFP. If you participate as a project developer, you have to apply for a Letter of Approval according to the guidelines in Statutory Order no 118 of 27th of February 2008 (https://www.retsinformation.dk/Forms/R0710.aspx?id=115264), if the credits from the project are to be used for return of Danish ETS operators, you are to apply for general approval of the project. The Statutory Order inter alia includes information about the size of fees for approval of and the documentation required for getting the application processed. In addition to the Statutory Order, a general guide has been composed containing further outlines of appliance for approval of climate projects in accordance with the aforementioned Statutory Order.

Background

The Kyoto Protocol (3/CMP.1, Annex, paragraph 29) states that all parties participating in the flexible mechanisms CDM and JI are to have a functional Designated National Authority/Designated Focal Point (DNA/DFP). The DNA/DFP is the institution responsible for authorisation and approval of participation in CDM/JI projects for legal or natural persons domiciled in Denmark. This was implemented in Denmark by Statutory Order no 118 of 27 February 2008. The Statutory Order also includes information about the size of fees for approval of climate projects. Furthermore, the Statutory Order stipulates that all projects, from which credits are to be used, must also be approved by the Danish state. This is also dealt with by the Danish DNA/DFP.



Specifically on approval of large hydropower projects

Article 11b (6) of the Emissions Trading Directive states that EU Member States are to ensure that large hydropower projects meet the international criteria and guidelines, including the report by the World Commission on Dams (WCD); “Dams and Development. A New Framework for Decision-Making". However, EU Member States have interpreted this Article in different ways. Previously, this has resulted in fragmentation of the market and prices of credits from exactly this type of projects. In autumn 2007 work was initiated on harmonisation of the approval procedures within the EU for this type of climate project. This process resulted in a non-paper stipulating the basis for this process and the extent of additional documentation required in order to approve this project type. Furthermore, a template (Compliance Report) on meeting the WCD guidelines was prepared. When seeking approval of large hydropower projects, this template must be filled in together with relevant documentation.
