Access to the natural gas market
Since 1 January 2004, all consumers of natural gas in Denmark have had access to the Danish natural gas market. Information to consumers on change of supplier etc., as well as information to gas suppliers on the basis for framework conditions for gas suppliers and shippers in the Danish natural gas system is available (in Danish) at www.gasmarked.dk
Pursuant to the Natural Gas Supply Act, access to the Danish transmission and distribution networks is subject to regulation. This means that use of the networks is subject to prices and terms of use made publically available by the transmission and distribution companies. Access to natural gas storage facilities is subject to negotiation. More detailed regulations have been laid down concerning access to the Danish natural gas system in Rules for Gas Transport prepared by Energinet.dk in cooperation with the distribution and storage companies.
Transmission, distribution and storage companies can refuse access to the system when capacity is inadequate, when access to the system prevents the companies from fulfilling their obligations under the Natural Gas Supply Act, or when there are grave economic or financial problems with take-or-pay contracts.
Access to the upstream pipelines that carry the natural gas onshore from the production sites in the North Sea is also subject to negotiation. Regulations on access to these upstream pipelines are stipulated in the Executive Order on access to the upstream pipeline network (only available in Danish).
Any complaints about prices or terms of use of the natural gas system, as well as complaints about rejections of requests for access to the system, may be brought before the Danish Energy Regulatory Authority. This Authority also serves as the authority for resolving disputes regarding access to storage facilities and upstream pipelines.
